Last week, the United States Court of Appeals for the Eleventh Circuit held oral argument on the issue of complete preemption as it pertains to the Copyright Act. An issue of first impression in the Eleventh Circuit, the Court will decide whether the plaintiff’s state law claim for unjust enrichment stemming from the defendant’s alleged use of videos and photographs should fall within the purview of the Copyright Act, thus precluding the action from being litigated in state court where it was initially filed.
